House Democrats seek authorization to intervene in ACA lawsuit

House Democrats introduced a package of rules for the 2019 session that includes a provision calling for authorization to intervene in Texas v. United States, the lawsuit that seeks to dismantle the ACA.

The lawsuit was brought by 20 state attorneys general seeking to dismantle the ACA. The lawsuit claims the individual mandate became unconstitutional when the 2017 tax law eliminated the associated penalty and that the mandate is inseverable from the rest of the law, making the ACA unconstitutional. On Dec. 14, U.S. District Judge Reed O'Connor ruled in favor of the 20 states. Another 17 states have appealed the decision.

The Democrats' package of rules also seeks authorization for the speaker of the House to intervene in any other lawsuits involving the ACA.

The House will vote on the package Thursday after appointing the speaker, according to The Hill.
