The Supreme Court has denied conservative group Freedom Watch's motion seeking to exclude Justice Elena Kagan from participating in the appeals over the constitutionality of healthcare reform, according to a New York Times report.
Freedom Watch requested permission to make oral arguments in addition to submitting a friend-of-the-court as brief about the law. The request was denied, a decision that Justice Kagan did not participate in, according to the report.
Larry Klayman, founder of Freedom Watch, said Justice Kagan should not participate because of a conflict of interest, citing her involvement in drafting and supporting healthcare reform legislation when she worked in the Department of Justice.
Justice Clarence Thomas is also under pressure to recuse himself from the healthcare case. Many claim he has a conflict of interest, as his wife openly opposes healthcare reform and is working to have it repealed, according to the report.
