Hospital Foundation Sues to Stop Efforts to Move Forward Bert Fish, Florida Hospital Merger

The Bert Fish Foundation has filed a motion to stop the "the continued solidification of bonds" between Bert Fish Medical Center in New Smyrna Beach, Fla., and Florida Hospital in Orlando, according to a News-Journal report.

Bert Fish merged with Florida Hospital in July. Following, the foundation sued alleging violation of the state's Sunshine Law. The Sunshine Law establishes a basic right of access to most meetings of boards, commissions and other governing bodies of state and local governmental agencies or authorities.

Bert Fish decided to re-hold meetings surrounding the merger. The first public meeting was held late last month, and the board decided to pursue an affiliation again.

The most recent filing seeks to cease any move to strengthen ties between Bert Fish and Florida Hospital, including personnel or HIT changes, while the litigation progresses, according to the report.

Attorneys for Bert Fish and Florida Hospital argue that the time frame for an injunction to stop the merger has passed, since the deal has already occurred. 

A hearing date on the injunction has not been set.
