State to pay $5M settlement in U of Iowa hospital negligence case

The state of Iowa will pay $5 million to settle allegations of medical negligence made against the University of Iowa Hospitals and Clinics in Iowa City, The Gazette reported June 21.

The $5 million will be paid out over 30 years, the report said. The settlement includes $4.25 million to a law firm and $750,000 to the family of a now 7-year-old girl with cerebral palsy. It stems from complications that occurred when the girl was born in July 2015.

According to a January 2018 lawsuit, the girl was born via cesarean section, and physicians recorded low Apgar scores. During resuscitation efforts, the girl suffered cuts to her neck and scalp and was given morphine for the pain. It also included "positive pressure ventilation for five minutes," according to the lawsuit. In the first few days of life, she was found to have had more than 100 subclinical seizures.

Because UI Physicians reached its annual cap, the state will pull the money from its general fund to pay the full amount.
