The lawsuit was filed by Gerald Nessmann, a member of Mayo Regional Hospital’s publicly elected board. The towns of Sebec and Monson later joined the lawsuit. Mr. Nessmann argued that the merger may not be in the best interest of Hospital Administrative District. No. 4’s member towns, which could lose their reserve fund to Northern Light Health after a merger.
Superior Court Justice William Anderson said the merger cannot yet be challenged because it had been completed.
“Declaring rights and responsibilities for a merger that may not even be completed or finalized in the form as presented to the Court now could put the Court at risk of issuing an advisory opinion,” the judge wrote. “This would be improper.”
