ONC Issues Proposed Rule for Discipline of Accreditors

The Office of the National Coordinator for Health IT has proposed a rule that would issue disciplinary action for ONC-approved accreditors who engage in improper conduct or who do not perform responsibilities under the permanent electronic health records certification program.

Among other things, the permanent EHR certification program provides a process by which an organization may become an ONC-authorized certification body to certify complete EHRs or EHR modules. Those interested organizations must undergo accreditation from an ONC-approved accreditor.

The ONC’s proposed rule seeks disciplinary action, chiefly through revocation of status and suspension, for any ONC-approved accreditor for any improper conduct or failure to carry out their duties under the permanent certification program. ONC also proposes to “address the status of ONC-authorized certification bodies in instances where there may be a change in the accreditation organization serving as the ONC-approved accreditor and clarifies the responsibilities of the new ONC-approved accreditor.”
