Court of Appeals Invalidates NLRB Notice Posting Rule

The U.S. Court of Appeals for the 4th Circuit has ruled that the National Labor Relations Board exceeded its authority when it issued a rule requiring all employers subject to the National Labor Relations Act to post a notice informing employees of their rights under the act, according to an AHA News Now report.

The court affirmed that the NLRB lacks the authority to issue such a rule. This is the second time the NLRB rule has been invalidated by an appeals court. The U.S. Court of Appeals for the District of Columbia invalidated the rule in May.
