Which physician specialties are most likely to sue another physician for harm?

Physicians are usually thought of as only being on the receiving end of a malpractice lawsuit, but it’s not unheard of for a physician to launch such a case against another medical professional, according to the “Medscape Malpractice Report 2015: Why Most Doctors Get Sued.”

The Medscape survey was conducted from Sept. 21 to Nov. 3, and includes responses from nearly 4,000 U.S. physicians.

Based on the survey results, some physician specialties are more likely than others to sue a physician who has harmed them. Highlighted below are the specialties most likely to launch a malpractice lawsuit against another physician.

1. Oncology — 26 percent said they would sue another physician

2. Anesthesiology — 25 percent

3. Radiology — 25 percent

4. Orthopedics — 19 percent

5. Surgery — 19 percent

6. Internal/family medicine — 17 percent

7. OB-GYN & women’s health — 15 percent

Interestingly, among those surveyed by Medscape, OB-GYNs are the specialists most often named in malpractice lawsuits and the least likely to sue another physician. Meanwhile, oncologists are the specialists least often named in malpractice suits and the most likely to sue another physician.
