ONC Publishes Final Rule on ONC-Approved Accreditor Discipline Process

The Office of the National Coordinator for Health Information Technology has released the final rule on the process for disciplining the ONC-Approved Accreditor if it acts improperly or does not perform its responsibilities under the permanent certification program.

The proposed rule, "Permanent Certification Program for Health Information Technology; Revisions to ONC-Approved Accreditor Processes," suggested a removal process for changing the ONC-AA in the case of improper conduct or failure to fulfill responsibilities. The proposed rule was published on May 31 and ended its comment period on Aug. 1. As ONC did not receive any public comments, the final rule is essentially the same as the proposed rule.

The rule allows ONC to propose the removal of the ONC-AA for conduct or responsibility violations. The ONC-AA would have the opportunity to respond to the proposal of removal and provide evidence that the violation did not occur or has been corrected.
