WellStar Loses Latest Appeal to Delay Northside Hospital's $250M Project

Marietta, Ga.-based WellStar Health System has lost its latest appeal against Atlanta-based Northside Hospital in a bid to stall the hospital's plans to relocate and replace a facility, according to a Cherokee Tribune report.

The state has ruled that Northside does not need a certificate of need to build an approximately $250 million replacement facility for its Northside Hospital-Cherokee in Canton, Ga.

WellStar has opposed this decision from the outset, having filed a formal objection to Northside's CON exemption request in September. The health system appealed the ruling in November and again in March when the second attempt failed to overturn the CON exemption. However, this recent rejection may not stop WellStar's effort: It may file a lawsuit in other counties' superior courts to seek a judicial review of the state's ruling, according to the report.

WellStar argues Northside's plans to build an 84-bed hospital will expand the hospital's services, which would require a CON. Northside maintains its current plans are only to replace the hospital, though a future project may add a women's center, multi-specialty medical office building and cancer center.
