The American Hospital Association and three other healthcare organizations have filed an amicus brief defending Tennessee’s 340B contract pharmacy law, which is facing a challenge from the pharmaceutical industry.

- On June 27, the AHA — along with 340B Health, the Tennessee Hospital Association and the American Society of Health-System Pharmacists — filed an amicus brief in federal court urging the dismissal of a lawsuit by the Pharmaceutical Research and Manufacturers of America, according to an June 30 news release from the AHA.
- Tennessee’s law prevents drug manufacturers from denying 340B discounts on medications dispensed through contract pharmacies, with an aim to ensure hospitals receive the same discounted pricing whether drugs are distributed in house or through outside partners. PhRMA alleges the Tennessee statute violates the Constitution by interfering with federal drug pricing and distribution standards.
- The amicus brief filing is one of many AHA has made in support of similar state laws across the country, with a nearly identical brief submitted earlier in June for a separate case involving AbbVie.
