Physician Sues Memorial Hermann in Houston for Retaliation, Defamation

A physician has sued Houston-based Memorial Hermann Hospital System, claiming it placed him on the National Practitioners Data Bank's adverse action report after he tried to address violations of the federal Emergency Medical Treatment and Active Labor Act at one of the system's hospitals, according to a Southeast Texas Record report.  

Emergency medicine physician Walter Zawislak, MD, claimed he attempted to address EMTALA violations at Memorial Hermann Southeast Hospital in Houston. He claimed there were instances in which physicians on the hospital's on-call list "failed or refused to appear within a reasonable period of time" after they were notified to treat a patient.

Dr. Zawislak claimed Memorial Hermann attributed the alleged wrongdoing to him and published a statement regarding "adverse action against [his] clinical privileges for substandard or inadequate care" on the NPDB. Dr. Zawislak said he did not know he was the subject of an investigation until after his resignation, according to the report.

The physician said the ordeal has since made it difficult for him to retain or obtain employment. He seeks unspecified monetary damages, a jury trial and an injunction removing his name from the adverse outcome report.
