The plan is the in-house insurance arm of the Board of Cooperative Education Services. Massena Memorial Hospital and the BOCES have had an agreement since 1997 that it would reimburse the hospital 92 percent for medical expenses incurred by plan members. The hospital’s initial complaint was filed Aug. 31 and claimed that between 2011 and May 2017, the BOCES has missed $3,786,298.83 in payments.
Lawyers for the BOCES argue the hospital did not itemize its claims or give proper notice for claims, as school districts are unable to be sued for claims over a year old. The hospital alleges they complied will all notice requirements.
