The Oneida County Industrial Development Authority had attempted to use eminent domain to obtain the land on behalf of the health system.
Bowers Development, a real estate development company and the petitioner in the case, had signed a purchase agreement for the property before the use of eminent domain was discussed.
The land parcel, currently occupied by J.P. O’Brien Plumbing and Heating, would have been used by the hospital to construct a parking lot for the medical office building.
