Florida practice settles nurse retaliation lawsuit for $50K

A pediatric medical practice in Florida will pay $50,000 to settle a retaliation discrimination suit filed by the U.S. Equal Employment Opportunity Commission on behalf of a former nurse at the practice.

The suit, filed June 2020, claims Tampa-based Pediatric Health Care Alliance transferred the nurse to another location, where she earned less overtime pay and lost some nursing duties, after she reported being inappropriately touched by a physician. The medical practice violated Title VII of the Civil Rights Act of 1964, which prohibits employers from retaliating against employees who report discrimination, the EEOC alleged.

Under the agreement, Pediatric Health Care Alliance will also update its retaliation policy, conduct Title VII training, provide annual reports to the EEOC and post an anti-descrimination notice, the commission said July 20.
