ACLJ Files Second Suit Against Mandated Coverage of Contraceptives

The American Center for Law and Justice, a pro-life legal group, has announced it has filed a lawsuit in federal court challenging HHS’ requirement that employers must provide health insurance with coverage for contraceptives to their employees.

The ACLJ represents Korte & Luitjohan Contractors, a Highland, Ill.-based contractor with 90 employees. Cyril B. Korte and Jane E. Korte, who own a controlling interest in the company, contend the HHS mandate does not align with their Catholic faith. Korte & Luitjohan provides health coverage to approximately 20 of its non-union employees.

The suit contends the requirement violates the Free Exercise Clause, the Establishment Clause, and the Free Speech Clause of the First Amendment. It also argues the mandate violates the Religious Freedom Restoration Act and the Administrative Procedure Act.

In March, the ACLJ filed a similar federal suit on behalf of St. Louis-based O’Brien Industrial Holdings.
