Legislators Ask Tennessee Hospitals to Settle Antitrust Clash

Tennessee legislators have asked Jackson-Madison County General Hospital and a competing hospital to work out a deal to revise bills that would remove JMCGH’s antitrust protection, according to report by the Jackson Sun.

As currently written, the bills would revise a 1996 law that protects private-act hospitals such as JMCGH from antitrust litigation, allowing them to enter exclusive contracts with insurers. Regional Hospital of Jackson, the competing hospital, contends the current arrangement gives JMCGH an unfair advantage in the marketplace.

If the hospitals cannot come to a compromise, the Tennessee House subcommittee considering the bills could end up with a split vote on the matter, a legislator said.
