Judge Questions Legality of Secrecy Clause in University of Iowa Hospitals Malpractice Settlement

District Judge Eliza Ovrom has objected to a clause in a medical malpractice case against the University of Iowa Hospitals and Clinics that would require the plaintiffs to keep secret the settlement terms, according to a Bloomberg Businessweek report.

The clause in question was part of a $475,000 settlement UIHC reached with the estate of a man who died in a 2005 procedure. Judge Ovrom questioned the secrecy clause, suggesting it violated an Iowa law passed in May that would make settlement agreements public record when a public body is being sued, according to the report.

Judge Ovrom agreed to the settlement, but cautioned that the confidentiality provision could not apply in the state of Iowa.
