CMS is providing an additional 60 days for comment on how EMTALA is applied to specialized facilities, and the AHA plans to urge the law remain unchanged, according to the report.
CMS had previously considered expanding the application of the EMTALA to inpatients in need of transfers to specialized facilities. The AHA opposed the expansion, which could have required specialized hospitals to accept transfer patients who could not be stabilized at their current hospital.
