CMS Holds Off on Supervision Rules for Outpatient Therapeutic Services

In its final rule for hospital outpatient services, CMS is putting on hold an earlier proposal to change physician supervision requirements for outpatient therapeutic services in 2011.

Instead, CMS will seek input from an advisory committee on its proposal to require direct supervision for initiation of the service, followed by general supervision for 16 specific services. The services include direct admission of a patient for hospital observation care, intravenous infusions for therapy, prophylaxis or diagnosis and subcutaneous infusions for therapy or prophylaxis.

Meanwhile, the agency will not enforce a direct supervision requirement for therapeutic services for outpatients at critical access hospitals, following a suspension of that requirement in March. The AHA recently stated it would support a bill in the U.S. House allowing general physician supervision for many outpatient therapy services.
