The Injured Patients and Families Compensation Fund is operating with a $783 million surplus, which WSJ notes is $406 million over what is recommended. The $1.2 billion fund’s total current assets are greater than the amount of claims it has paid since its creation in 1975.
The Wisconsin Medical Society backed the fund, stating that it had to be large enough to cover unexpected cases, according to the report. However, Wisconsin is the 49th state in malpractice payments per capita, according to data cited in the report from the National Practitioner Data Bank, which indicates that malpractice cases may be particularly tough to win in Wisconsin.
