Illinois enacts law shielding abortion records from out-of-state entities

Illinois Gov. J.B. Pritzker has signed legislation that restricts the disclosure of abortion-related medical records to out-of-state entities.

The Reproductive Health Records Privacy Act, signed June 24, takes effect July 1, 2027. The law requires information related to abortion services or gender dysphoria diagnoses to be separated from patients’ electronic medical records and limits access by out-of-state entities except in certain circumstances with patient consent.

About 32,000 out-of-state residents sought abortion services in Illinois in 2025, making the state the destination for nearly a quarter of the 142,000 people who traveled out of state for abortion care, according to a report from the Guttmacher Institute.

The law comes amid a broader federal push to access reproductive and gender-affirming care records. In May, a federal subpoena sought patient records from NYU Langone Health related to gender-affirming care, part of a Justice Department investigation that has targeted more than 20 physicians and clinics nationwide since 2025.
