According to the suit, the IRS erroneously denied Express Scripts’ deductions and refused to refund the PBM more than $18 million in 2010 and nearly $25 million in 2011.
Express Scripts said it filed amended taxes in 2018 for the 2010 and 2011 tax years and that the IRS denied the claims in March 2021. The IRS allegedly denied the refunds because Express Scripts didn’t qualify for the domestic production activities deduction.
Express Scripts is asking the court to order the IRS to issue the refunds and to cover Express Scripts’ attorney fees.
