12 pharmacies sue Express Scripts over alleged underpayments

Twelve independent Arkansas pharmacies have sued Express Scripts, alleging the PBM reimbursed them below the minimum required under Arkansas law tens of thousands of times.

The lawsuit was filed Sept. 15 in St. Louis County Circuit Court. The pharmacies allege Express Scripts paid below the statutory reimbursement floor on prescription claims beginning around Aug. 5, 2025, and that the alleged underpayments are ongoing.

Individual pharmacies identified between 662 and 7,472 allegedly underpaid claims through at least March 31. The plaintiffs allege each below-floor reimbursement represents a separate violation.

The pharmacies are seeking compensatory damages, actual financial losses and statutory damages of up to $10,000 for each violation. They are also seeking declaratory and injunctive relief, attorneys’ fees and costs.
