Brent Varney received treatment at the hospital in March 2016. He claims his ex-wife, Ms. Varney, unlawfully accessed his data and that CAMC is responsible for its failure to develop or implement adequate systems to safeguard patients’ personal information.
The complaint, filed in Kanawha Circuit Court, alleges negligence, invasion of privacy and other counts. Mr. Varney is requesting a trial by jury and seeking actual, compensatory and punitive damages, plus interest, costs, attorney’s fees and any further relief that the court may deem fair and proper, according to West Virginia Records.
