Tallahassee (Fla.) Memorial HealthCare has dropped a lawsuit seeking a temporary injunction to remove a former patient who remained in an inpatient room for about five months after being discharged, the health system confirmed in a statement shared with Becker’s.
“TMH can confirm that this legal case is no longer active, and the person is no longer at TMH,” a spokesperson said.
The complaint, filed March 2 in the Circuit Court of the Second Judicial Circuit in Leon County, Fla., asked the court to order the individual to vacate the hospital and authorize the Leon County Sheriff’s Office to assist with enforcement.
According to the filing, the patient was discharged Oct. 6 after the attending physician determined she no longer required acute care services but continued occupying an inpatient room.
Tallahassee Memorial said in the complaint that the patient’s continued presence prevented the hospital from using the bed for patients who require acute care and diverted staff resources.
A hearing on the request for a temporary injunction had been scheduled for March 30 but was later canceled. Tallahassee Memorial filed a notice of voluntary dismissal with prejudice after the patient left the hospital.
