According to the report, CMS did not have a policy in place to specifically address payments to unlawfully present beneficiaries under Medicare Part D similar to the policy that covers payments for these beneficiaries under Part A and Part B. Because of this missing policy, many beneficiaries in the country illegally were considered eligible for Part D benefits, and received payments from CMS.
The report found between 2009 and 2011, CMS inappropriately accepted 279,056 prescription drug event records on behalf of 4,139 unlawfully present beneficiaries and improperly paid out $29.0 million in benefits.
