Late last year, the NLRB published a final rule that amends election case procedures to reduce “unnecessary litigation and delays.”
Unions have shown their support of the final rule, but the U.S. Chamber of Commerce and the Coalition for a Democratic Workplace filed a lawsuit against NLRB in a Washington, D.C., district court, alleging the rule is an attempt by the board to help unions.
“The final rule significantly limits or wholly eliminates certain important aspects of the pre-election hearing process rendering the hearing ‘inappropriate’ under the [National Labor Relations Act],” the amicus brief stated. The AHA is joined by the American Society for Healthcare Human Resources Administration, American Organization of Nurse Executives, the HR Policy Association and Society for Human Resource Management.
