Last May, a federal appeals court revived a class-action lawsuit alleging AARP solicited UnitedHealth plans to California members without a license. The lawsuit also claimed AARP received commissions for the promotions, Reuters previously reported.
In Los Angeles on Tuesday, U.S. District Judge Dean Pregerson denied AARP and UnitedHealth’s argument the lawsuit was banned under California law. AARP and UnitedHealth had argued California’s insurance regulator knew about the payments from reviewing the policy’s rates, according to the report.
