The suit, filed in December, claims BCBS of Michigan inhibited Aetna from expanding in the state. It followed a suit by the Department of Justice and Michigan attorney general’s office alleging BCBS inhibited competition by including most-favored nation clauses in contracts with providers.
Blue Cross has defended its use of the clauses to reduce premium increases, according to the report.
