St. John CFO Patrick McGuire and Borgess Senior Vice President and CFO Richard Felbinger are not defendants in the government’s suit, but are defendants in a related civil suit by the city of Pontiac, Mich.
The U.S. Department of Justice and Michigan attorney general’s office brought the suit in 2010, claiming the Blues’ “most favored nation” clauses in reimbursement contracts require Michigan hospitals to bill competing payors at prices either equal to or higher than those of the Blues.
Attorneys representing Burgess and Providence tried to quash or modify the subpoenas served on the CFOs, but a judge denied those requests.
