The health system filed the motion with the McHenry County Circuit Court, asking Administrative Law Judge Richard E. Hart to decide the appeal’s merit instead of delaying the appeal process due to a clerical error.
Centegra appealed a state board’s CON denial for a new hospital, and Judge Hart was assigned to review the board’s decision in February. Judge Hart said there was a clerical error in related files and recommended the board reconsider the proposal with the error corrected. Centegra said this decision could significantly delay the CON process.
In December, a state board rejected Centegra’s proposal to build a new $233 million hospital in Huntley, Ill. The decision, however, was based on a tie. The state board voted 4 to 4 with one board member absent. Under the board’s rules, a tie is considered a denial, according to the report.
