Average plaintiff award by region in malpractice lawsuits

More than half of malpractice lawsuits result in no award to the plaintiffs, according to recent survey from Medscape of roughly 4,000 primary care physicians and specialists.

However, almost a third — 29 percent — result in awards of more than $100,000. Just 12 percent of settlements result in awards of over $500,000, yet the survey found these big ticket settlements are not evenly spread by geographic region.

By region, here is the portion of monetary awards that top $500,000, according to Medscape.

  • Northeast (Maine, New Hampshire, Vermont, Massachusetts, Connecticut, New York and Rhode Island) — 18 percent
  • Northwest (Montana, Wyoming, Idaho, Oregon and Washington) — 15 percent
  • MidAtlantic (West Virginia, Virginia, Delaware, Maryland, Washington, D.C., North Carolina, Pennsylvania and New Jersey) — 14 percent
  • Southwest (Arizona, Utah, Colorado, New Mexico and Nevada) — 12 percent
  • Great Lakes (Ohio, Michigan, Indiana, Illinois, Wisconsin and Minnesota) — 11 percent
  • Southeast (South Carolina Georgia, Florida, Alabama, Mississippi, Louisiana, Tennessee and Kentucky) — 9 percent
  • West (California, Alaska and Hawaii) — 8 percent
  • South Central (Texas, Oklahoma and Arkansas) — 7 percent
  • North Central (Iowa, Missouri, Kansas, Nebraska, South Dakota and North Dakota) — 5 percent
