AHA backs Louisiana 340B law in court

The American Hospital Association has filed briefs in three federal cases supporting Louisiana’s 340B contract pharmacy law. 

The briefs, filed in the U.S. Court of Appeals for the Fifth Circuit, oppose legal challenges from PhRMA, AbbVie and AstraZeneca, which argue that the federal 340B statute overrides state law, according to an April 21 AHA news release. 

The law bars drug manufacturers from withholding 340B discounts on medications dispensed through community pharmacies. 

The AHA has filed similar briefs in prior Louisiana proceedings and in other states. The Louisiana Hospital Association, the Rural Hospital Coalition, 340B Health and the American Society of Health-System Pharmacists joined the AHA in the recent filings.
