Here are seven things to know.

1. The hospital sued the Massachusetts Nurses Association in a Boston federal court regarding the matter. The union represents the nurse previously dismissed by HFH.

2. The lawsuit, filed July 7, claims the arbitrator did not have authority to reinstate the nurse, Maureen Bean, according to the report.

3. Ms. Bean, the lawsuit states, allegedly violated the hospital’s “disrespect policy” when she confronted and cursed at a supervisor over a denied vacation request, Boston Business Journal reports. The report states Ms. Bean also allegedly contacted a colleague at home “at least four times” in January of last year “to pressure her to withdraw a vacation request for the same period.”

4. The following month, Ms. Bean allegedly assaulted and then shortly thereafter expressed remorse to the colleague, the lawsuit claims. The hospital ultimately terminated Ms. Bean after learning about the incidents.

5. The Massachusetts Nurses Association fought the termination via arbitration. In the end, the arbitrator, Michael Stutz, “found the actions inappropriate,” but determined “they weren’t violent and didn’t justify termination,” according to the report.

6. The hospital disputes this decision and is asking the court to vacate Mr. Stutz’s decision, the report states.

7. The hospital declined to comment further on the lawsuit when contacted by Becker’s Hospital Review. The Boston Business Journal was unable to immediately reach the MNA for comment.
