Nine people have filed suit against Barnwell County (S.C.) Council members, claiming they breached their fiduciary duty in the sale of Barnwell County Hospital to Dobbs Equity Partners, according to an Augusta Chronicle report.

In September, South Carolina’s Barnwell and Bamberg counties agreed to sell their hospitals to Dobbs Equity Partners, which would begin bankruptcy proceedings to organize debts. The hospitals would then merge to create a new regional facility.

The suit — filed by some members of Barnwell hospital’s board — asks that the resolution made by the council members to sell the hospital be declared illegal and unconstitutional. It claims the council members breached their various duties by approving interest loans, financially crippling the hospital and forcing it into bankruptcy.

The suit was filed in the Court of Common Pleas for the Second Judicial Circuit.
