The CNA filed suit nearly a year ago charging that the planned $320 rebuild of the hospital endangered the health of the community, because it would cause other facilities to close, including the existing San Leandro Hospital, reducing access for some low-income residents, according to the report.
After learning of the dismissal, the hospital announced it would move forward with plans to build the new facility, which it hopes to open by Jan. 2013, according to the report.
