Mother sues Rady Children's following security breach

The mother of a patient of Rady Children's Hospital in San Diego is suing the hospital over a data breach that occurred earlier this year, according to an ABC10 News report.

In June, the hospital notified the parents of more than 20,000 patients after discovering the protected health information of those patients was accidently emailed to job applicants.

The patient in the lawsuit was receiving treatment and counseling at Rady Children's for treament in the aftermath of a sexual assault incident. Following the breach, the patient received a letter from an outside company asking her to participate in a medical study about depression, leading the mother to believe the company accessed her daughter's information through the data breach, according to the report. The suit accuses the hospital of violating the Medical Records Confidentiality Act as well as failing to adequately protect patient information, according to the report.

A Rady Children's spokesperson said mailing and email addresses of patients were not on the spreadsheets accidently sent to the job applicants and does not believe the company accessed the patient's information from the breach, according to the report.
