Epic has asked the Wisconsin Court of Appeals to uphold the dismissal of a lawsuit brought by Veeva Systems challenging Epic’s noncompete agreements.
The life sciences software maker sued the EHR giant in January, arguing Epic’s restrictive covenants unreasonably restrict Veeva’s ability to recruit former Epic employees to its Madison, Wis., office. Judge David Conway of Dane County Circuit Court dismissed the case with prejudice April 29, ruling that Veeva lacked standing because it was not a party to Epic’s employment agreements. Veeva appealed the ruling July 24.
In its response brief, filed in late August, Epic argues Veeva “is neither a party to nor a third-party beneficiary” of the employment and stock purchase agreements it seeks to void, and that allowing a competitor to challenge another company’s contracts would create an “unauthorized advisory opinion.” Epic also contends Veeva failed to plead the elements of tortious interference, noting the one candidate who withdrew from Veeva’s hiring process did so based on what Epic calls a misreading of the noncompete’s terms. Epic asks the appellate court to affirm the dismissal with prejudice.

The case is one of several legal disputes over Epic’s employment practices. A former Epic employee sued the company in California federal court in July alleging its noncompete violates state law, and the state of Texas filed a lawsuit against Epic in December 2025 claiming its noncompete and no-hire agreements restrict employee mobility.
