A federal lawsuit tied to Prospect Medical Holdings’ 2023 data breach has been voluntarily dismissed.
According to a filing in the U.S. District Court for the Eastern District of Pennsylvania, plaintiffs and Los Angeles-based Prospect Medical Holdings jointly filed a stipulation May 4 to dismiss the case without prejudice under Federal Rule of Civil Procedure 41(a)(1)(A)(ii). Judge Wendy Beetlestone approved the dismissal May 5. Becker’s reviewed the filing.
The case, In Re Prospect Medical Holdings Inc. Data Breach Litigation, consolidated claims related to the health system’s 2023 cyberattack and data breach.
The filing states that each party will bear its own fees and costs.
