A coalition of state attorneys general has opened an investigation into OpenAI that includes scrutiny of how the company handles consumer health data, according to a subpoena viewed by The Wall Street Journal.
New York Attorney General Letitia James served OpenAI with the subpoena Friday, seeking documents across a wide range of the company’s practices, according to the June 12 story. New York is leading a coalition that also includes Colorado and other states, The New York Times reported.
The requested records cover the use of health data and consumer data, advertising, user engagement and retention, activities involving minors and seniors, deep learning models, model sycophancy, and company policies.
“We take the concerns raised by state attorneys general seriously and intend to engage constructively with their offices,” an OpenAI spokesperson told the Journal.
Separately, OpenAI faces a lawsuit that seeks to halt the rollout of ChatGPT Health after a teenager fatally overdosed after consulting the chatbot.
