Sen. Marco Rubio: ACA’s reinsurance program is ‘unacceptable’

On March 8, Republican presidential candidate Sen. Marco Rubio wrote a letter to HHS Secretary Sylvia Burwell and Department of the Treasury Secretary Jacob Lew addressing concerns with the Affordable Care Act’s reinsurance program, according to The Hill.

The letter was co-written with Sen. Orrin Hatch (R-Utah), the chairman of the Senate Finance Committee and one of Sen. Rubio’s campaign backers.

“We are again disappointed with the Administration’s willingness to unlawfully direct money to health insurers at taxpayers’ expense,” Sen. Rubio and Sen. Hatch wrote.

The letter expresses Sen. Rubio and Sen. Hatch’s discontent at the Obama administration’s recent redistribution choices. But in 2014, there weren’t enough funds collected to redistribute the required $10 billion to insurers and $2 billion to the Treasury. Thus, through regulations, the administration “prioritized giving money to insurers over the $2 billion to the Treasury,” according to the report.

“This is unacceptable,” the letter said. “The statute in question is unambiguous, and the [HHS] regulation and recent practice violates its clear directive.”

To assist their argument, Sen. Rubio and Sen. Hatch outlined a report from the Congressional Research Service, which found the administration’s choice “would appear to be in conflict with a plain reading” of the ACA, according to the report.
