Jim Fason, Senior Counsel, Legal, CarePayment: The Telephone Consumer Protection Act (TCPA) rules are helpful for patients and healthcare providers to keep channels of communication open via available technology. It’s best for healthcare providers to obtain patient consent to use these technology methods in their admissions forms and other patient-facing materials. This ensures providers and their third parties are covered on consent to use auto-dialers, pre-recorded messages, text/SMS messages and other technology in reaching patients not only for information associated with their healthcare, but also related matters like information on payment plan options and post-treatment account servicing.
