MedPAC makes 3 ‘two-midnight’ rule recommendations

The Medicare Payment Advisory Commission made several recommendations to CMS regarding its “two-midnight” policy in final recommendations approved Thursday, according to the American Hospital Association.

MedPAC made the following recommendations, according to the AHA.

1. CMS should withdraw the two-midnight rule and focus Recovery Audit Contractor reviews on hospitals that have the highest number of inpatient stays.

2. RAC contingency fees should be tied to their denial overturn rate.

3. The look-back period for RAC patient status reviews should be shortened.
