Anthem sued Express Scripts in March over a contract dispute.
Their dispute regards how much Anthem pays Express Scripts for prescription drugs. In January, Anthem CEO Joseph Swedish said Express Scripts wasn’t giving his company enough money in savings on prescription drug medication, and that it was “entitled to improved pharmaceutical pricing that equates to an annual value capture of more than $3 billion.”
But when Express Scripts disagreed, Anthem sued for approximately $15 billion in March.
Earlier this week, Express Scripts refuted Anthem’s claims and made its own arguments in a filing in the U.S. District Court for the Southern District of New York.
Express Scripts said it made five proposals to Anthem between June 2015 and March 2016, all of which would have given Anthem “billions of dollars in additional value” — between $2 billion and $2.8 billion in savings, according to the report. Express Scripts also said Anthem’s management team is “improperly attempting to re-write” the contract between the two organizations.
