Lawsuit alleges CVS Health didn't pay nurses overtime

A lawsuit alleges that CVS Health did not properly pay utilization management and review nurses because it classified them as employees exempt from overtime pay, Class Action reported April 14. 

The lawsuit, filed April 6 by two nurses who conduct medical authorization requests for CVS, allege that until April 2023, they worked 45 to 60 hours per week and should receive more payments for working outside typical shift hours. 

According to the nurses, CVS did not pay non-exempt nurses proper overtime wages after it misclassified them as exempt from overtime pay.

In March 2023, the employees allege that CVS reclassified them as hourly, non-exempt employees, and had not paid utilization management and reviewed nurses' overtime wages prior to their reclassification. 

The lawsuit seeks to represent anyone who worked for CVS Health in utilization management.
