New York state first to outlaw sale of most flavored vaping products

New York state is the first in the country to ban the sale of most flavored e-cigarettes.

The Public Health and Health Planning Council, which is part of the New York State Department of Health, voted Sept. 17 to carry out Gov. Andrew Cuomo’s emergency resolution, which bans the sale of all flavors of e-cigarettes except for tobacco and menthol for 90 days. The legislation would need to be renewed to stand after the 90-day period, according to a CNN report.

The legislation gives retailers until Oct. 7 to comply, after which visits will be conducted to enforce the ban. Violators will face fines of up to $2,000 per violation.

As of Sept. 11, there have been 380 confirmed and probable cases of lung disease associated with e-cigarette use, or vaping, in 36 states. Seven people have died as a result, according to a previous CNN report.

New York state Health Commissioner Howard Zucker, MD, told CNN there have been 74 confirmed cases of serious lung illness cases connected to vaping in the state.

Michigan has also introduced a ban on the sale of flavored vaping products.
