The third gender category, “X,” will become an available option Jan. 1, 2019, and a physician’s note or healthcare provider’s affidavit will no longer be required to change gender categories. Legislation to include the change was first introduced in June. City officials told NBC News New York City Mayor Bill de Blasio is expected to sign the legislation soon.
With the change, New York City will join California, Oregon, Washington and New Jersey in allowing people to select nonbinary gender options on their birth certificates.
