Ms. Holmes’ lawyers presented her appeal in a California federal appeals court June 11. The defense is seeking a new trial, arguing that the judge made several errors during her 2022 trial.
Federal prosecutors contend that the lower court handled the case correctly and that any potential trial errors were harmless due to the substantial evidence against Ms. Holmes.
Ms. Holmes was sentenced to 11 years in prison in November 2022 for defrauding investors about her startup’s technology, finances and business prospects. She is serving her sentence, which has since been reduced by two years, in a minimum-security facility in Texas.
The appeals court’s decision is expected to take several weeks or months, according to the report.
