Without the delay, the audit and reporting rule would go into effect this month in many states. With the delay, CMS would have time to review state audits of Medicaid DSH payments and adjust the rules.
A letter from the lawmakers said the rule contains “potential disallowances for the upcoming state plan year” and “implements dramatic policy changes” beyond Congress’ intent.
